1. Acceptance of Terms

By accessing or using the Kinsie app, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility and Your Account

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and keep it current.

We may suspend or terminate your account if we reasonably believe you have violated these Terms in a material way or if your continued use would cause material harm to Kinsie, other users, or third parties. Where practical, we will give you notice before taking action.

3. User Content

The Service may allow you to upload, submit, post, or otherwise make available content, including reviews, ratings, photos, routines, lists, comments, profile information, and other materials ("User Content").

You retain ownership of your User Content. By posting or submitting it through the Service, you grant Kinsie a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, store, reproduce, display, perform, modify, adapt, distribute, publish, and create derivative works from your User Content solely for the purpose of operating, improving, and providing the Service.

You represent and warrant that you have all rights necessary to provide the User Content and to grant the license above, and that your User Content does not violate any law or the rights of any third party.

4. Sensitive Personal Information

As part of your skin profile, you may choose to provide information about skin conditions, health-related concerns, or other sensitive personal attributes ("Sensitive Information"). This information is stored as a distinct data category and is handled with additional protections.

We use your Sensitive Information only to:

We do not sell, rent, or share your Sensitive Information in identifiable form. We may use aggregated, anonymized data derived from Sensitive Information (meaning data that cannot reasonably be used to identify you) for research, analytics, and business insights, including sharing such data with third parties. Any such aggregated data will not include your name, account information, or other details that could identify you individually. We do not use your Sensitive Information to serve targeted advertising.

You may update or delete your skin profile information at any time through the app. Deletion of Sensitive Information may reduce the personalization of your experience but will not otherwise affect your access to the Service.

5. Affiliate Links and Third-Party Retailers

Kinsie may include links to third-party retailers, products, or services. Some of these links may be affiliate links, meaning Kinsie may earn a commission if you click the link or make a purchase through it. This does not increase the price you pay.

Affiliate relationships do not influence which products appear in your personalized recommendations or match results. Product ranking is based on ingredient compatibility and peer outcomes from users with similar skin profiles, not commercial relationships.

When you click a third-party link, you may leave Kinsie and be directed to a third-party site or service not owned or controlled by Kinsie. Kinsie is not responsible for any third-party content, products, pricing, availability, shipping, returns, security, or policies. Any transaction you make with a third-party retailer is solely between you and that retailer.

6. Privacy

Your use of the Service is governed by our Privacy Policy, available at kinsie.app/privacy. The Privacy Policy describes how we collect, use, and protect your personal information, including Sensitive Information as defined in Section 4 above.

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, trademarks, features, and other content, is owned by Kinsie Inc. or its licensors and is protected by applicable intellectual property and other laws.

Except for the limited rights expressly granted to you under these Terms, no other rights are granted to you by implication or otherwise. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service without our prior written permission.

9. Service Changes and Availability

We may modify, update, suspend, discontinue, or remove any part of the Service at any time. We will try to give reasonable notice of material changes where practical.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. We also do not guarantee that any retailer link, product listing, or third-party integration will remain available or track correctly.

10. Disclaimers

Kinsie is a skincare discovery, community, and information platform. Content available through the Service, including reviews, routines, product information, match results, recommendations, and ratings, is provided for general informational purposes only and reflects the experiences and opinions of individual users.

Kinsie does not provide medical advice, diagnosis, or treatment. You should consult a qualified healthcare or dermatology professional for medical concerns about your skin.

Kinsie does not manufacture, inspect, stock, test, endorse, or guarantee products sold by third-party retailers. Product descriptions, ingredients, pricing, and availability may be supplied by users, brands, or retailers and may change at any time without notice.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement, except to the extent such warranties cannot be disclaimed under applicable law.

11. Limitation of Liability

To the fullest extent permitted by law, Kinsie Inc. and its officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or use, arising out of or related to your use of or inability to use the Service.

To the fullest extent permitted by law, Kinsie's total liability for any claim arising out of or relating to these Terms or the Service will not exceed the greater of: (a) the amount you paid to Kinsie, if any, in the 12 months before the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to indemnify and hold harmless Kinsie Inc. and its officers, directors, employees, contractors, affiliates, licensors, and service providers from and against any third-party claims, liabilities, damages, losses, and costs, including reasonable attorneys' fees, arising out of or related to:

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

13.1 Informal Resolution First

Before initiating any formal dispute process, you agree to contact us at legal@kinsie.app and give us 30 days to attempt to resolve the issue informally. Most concerns can be resolved this way.

13.2 Binding Arbitration

If informal resolution fails, you and Kinsie agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including disputes about the validity or scope of this arbitration agreement) will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

Arbitration will take place in Wilmington, Delaware, or via videoconference if both parties agree. The arbitrator's decision will be final and binding, subject to limited review under applicable law.

13.3 Exceptions

Either party may bring an individual claim in small claims court if the claim qualifies. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent unauthorized use of intellectual property or protect confidential information.

13.4 Class Action Waiver

YOU AND KINSIE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY.

13.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@kinsie.app within 30 days of first agreeing to these Terms. Your notice must include your name, account email, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles, except to the extent otherwise required by applicable law in your jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date above and, where practical, through the Service or by email. Your continued use of the Service after updated Terms become effective constitutes your agreement to the revised Terms.

If a change materially reduces your rights or increases your obligations, we will provide at least 14 days' notice before the change takes effect where required by applicable law.
